Terms of Service
Effective October 2, 2026
These Terms of Service (“Terms”) are an agreement between you and The McCarthy Group LLC (“Lead Latte,” “we,” “us”) governing your use of the Lead Latte CRM, including its website, apps and public pages (the “Service”). By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service and beta status
Lead Latte is a customer relationship management tool for real estate professionals, with features such as contacts, touches, pipeline and the Business Tracker, referrals, imports and Google Contacts sync, sequences, distress and farm lists, a business directory, open house and listing feedback pages, team messaging, a dashboard of widgets, and optional AI summaries.
Lead Latte is in active development and access may be limited by invitation or an early access approval. Features can change, be added or be removed, and the Service may contain bugs.
2. Eligibility and accounts
- You must be at least 18 and able to form a binding contract, and you must use the Service for professional purposes.
- You sign in with a Google account. You are responsible for that account, for any optional two-factor methods you set up, and for all activity under your login.
- Information you give us (including license number, brokerage and state) must be accurate and kept up to date. You represent that you hold any real estate license you state.
- Tell us promptly at the address below if you suspect unauthorized access. We cannot restore a second factor you have lost, and recovery may require us to reset it manually.
- Do not share your login. Share data with colleagues using the Team features.
3. Teams
A lead can invite members, and an agent can ask to join a lead’s team. Data you place in team-scoped features may be visible to the lead and other members according to the team’s settings. Leads are responsible for who they admit and the permissions they grant. Joining or leaving a team does not transfer ownership of information that the law or your brokerage agreement says belongs to someone else.
4. Your data
You own the data you put into the Service (“Your Data”). You give us a limited license to host, process, back up, display and transmit Your Data as needed to run and improve the Service for you, and to provide features you choose to use, such as sending it to Google or Anthropic. You can export Your Data and request deletion of your account at any time as described in the Privacy Policy.
You are solely responsible for Your Data, including that:
- you have the right to collect it and to use it in the Service;
- you have given contacts any notices and obtained any consents the law requires before you store their information or contact them;
- your use of it, including texts, calls and emails to contacts, complies with applicable laws such as the TCPA, CAN-SPAM, state do-not-call and privacy laws, fair housing laws and your brokerage’s policies.
5. Acceptable use
You agree not to:
- break the law or infringe anyone’s rights, or use the Service to send spam, harassing, deceptive or discriminatory messages;
- upload malware, or probe, scan or test the Service’s security without our written permission;
- access data that is not yours, bypass access controls or team visibility, or interfere with other users;
- scrape, resell, sublicense or provide the Service to third parties, or reverse engineer it except where the law allows;
- use bots or automated means to submit public forms, or evade bot protection;
- use the Service to build a competing product or to train machine learning models on its content;
- use public pages, short links or QR codes to point to unlawful or malicious content.
6. Third-party services and integrations
The Service connects with services we do not control, including Google (sign-in, Contacts, Maps), Cloudflare Turnstile, email delivery providers, Anthropic, Gravatar, MLS and listing websites, and calendar (iCal) feeds you add. Your use of them is subject to their terms. Sync with Google Contacts can create, change or delete contacts in your Google account according to the options you choose, so review your settings before running an import or sync. We are not responsible for third-party services or their availability.
7. AI features
AI features are optional. Output is generated automatically, may be inaccurate or incomplete, and is not legal, financial or professional advice. You are responsible for reviewing it before you use or send it. Propensity scores and similar insights are estimates meant only to help you prioritize outreach, not predictions or guarantees, and must not be used to discriminate against anyone on a legally protected basis.
8. Public pages and share links
Open house pages, listing feedback forms, shared business directory pages and short links are accessible to anyone who has the link. You decide what to publish and are responsible for its accuracy and for the information you ask visitors to give. If you publish another person’s name, photo, logo or details, you confirm you have permission to do so. Business directory entries are your own listings and recommendations; we do not endorse or verify the people or companies listed.
9. Not professional advice; real estate data
Lead Latte is software, not a brokerage, lawyer, accountant or advisor. Dashboards, market reviews, distress indicators, pipeline values, commission figures, and other information in the Service are only as accurate as the data entered or imported and are provided for convenience. Verify anything important against official sources, and do not rely on the Service for legal or regulatory deadlines such as contract dates and disclosures.
10. Fees
The Service may currently be provided without charge during the beta. If we introduce paid plans we will give you notice before any charge applies, and you may stop using the Service instead.
11. Our intellectual property
The Service, including its software, design, text and trademarks (such as Lead Latte), belongs to us and our licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in line with these Terms. Ninja Selling® and other third-party marks belong to their owners and are not affiliated with or endorsed by us unless stated. If you send us feedback or suggestions, we may use them without obligation to you.
12. Availability, backups and data loss
We work to keep the Service running and your data safe, but we do not guarantee uninterrupted or error-free operation, or that data will never be lost or corrupted. We make backups, but you should export anything critical on a regular basis and keep your own copies of important records.
13. Suspension and termination
You can stop using the Service and ask us to delete your account at any time. We may suspend or end your access, with or without notice, if you break these Terms, create risk or legal exposure for us or others, or if we discontinue the Service. After termination, provisions that by their nature should continue (including ownership, disclaimers, limits of liability and indemnity) will continue to apply.
14. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and availability. We do not warrant that the Service will meet your requirements, be secure, or be free of errors or data loss.
15. Limitation of liability
To the fullest extent the law allows, Lead Latte and its owners, officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost commissions, lost business or data, or loss of goodwill, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
16. Indemnity
You agree to defend and indemnify Lead Latte and its owners, officers and employees against claims, damages, losses and expenses (including reasonable attorneys’ fees) arising out of Your Data, your communications with contacts, your breach of these Terms, or your violation of law or third-party rights.
17. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Nevada, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.
18. Changes to these Terms
We may update these Terms from time to time. We will post the revised version here with a new effective date and, for material changes, notify you by email or in the app. Continuing to use the Service after a change takes effect means you accept it.
19. General
These Terms and the Privacy Policy are the entire agreement between us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
